Change of land use from residential to commercial in Colombia: curaduría, notary office and fines

A sign, the commercial registration (matrícula mercantil) or the administrator's approval does not turn a home into a shop. These are the three different procedures and the penalty if you open without the permitted use.

A first floor with a metal grille and a balcony with plant pots up top looks just like thousands of neighborhood houses. And yet, whether a shop, a clinic, or a bakery can operate there doesn't depend on the sign you hang, your commercial registration, or the administrator telling you "go ahead, no problem." It depends on whether the urban planning rules allow that use and whether you have the right paperwork. These are three separate decisions, and many people mix them up.

Short answer: the land use certificate is only informative and authorizes nothing; a modification affects design, not use; and the administrator's letter does not change the designated use of your unit. What does authorize changing the use of a building is a construction license in the adaptation modality.

First the certificate: it informs, it does not authorize

Before spending on plans, request the land use certificate or the urban planning norm certificate. These are informative opinions: they tell you which uses the rules allow for your property. They grant no rights, do not bind on their own, and do not modify an existing or already executed license. If the certificate comes back favorable, you cannot open with it in hand; you only know the path exists.

If the curator issues them separately from the license, the national fee is 1.67 UVT for the land use certificate and 8.34 UVT for the urban planning norm certificate. Verbal general information queries do not generate that fee. Where there is no curator, the procedure goes to the municipal or district licensing authority, and that rate is not presented as an automatic charge by the mayor's office; ask there how they calculate it. In Bogotá, for example, since August 8, 2023, these certificates are filed directly with the urban curatorships.

We already have a guide focused only on that paperwork: land use certificate before the curatorship. Here I won't repeat its details.

Adaptation, not modification

Numeral 3 of article 2.2.6.1.1.7 of Decree 1077 of 2015 defines adaptation as the authorization to change the use of a building or part of it, guaranteeing the total or partial permanence of the original property. Modification, by contrast, authorizes changing the architectural or structural design without increasing the built area. If your problem is use, requesting a modification is the wrong procedure.

The license is a prior act: it is issued by the urban curator or, if the municipality has no curator, by the competent municipal or district authority. And watch out: the curator cannot grant it if the local urban planning rules do not allow that use in your area. Changing what the POT (land use plan) permits is a different discussion, one of municipal planning, which is not resolved at a curatorship.

How much does it cost? There is no flat price here. The fee comes from a formula in Decree 1890 of 2021 with a fixed charge of 10.01 UVT and a variable charge of 20.02 UVT, which are multiplied by factors for use, municipality, and area. Those two numbers are pieces of the formula, not the total. Ask the curator for the calculation in writing before paying.

Two paths: horizontal property and independent house

If your unit is under horizontal property regime, three layers apply that do not replace one another:

  • The urban planning norm must allow commercial use.
  • The general assembly must approve the change of designation and the amendment of the bylaws with 70% of the coefficients of the entire building or complex, not 70% of those attending. According to articles 45 and 46 of Law 675 of 2001, that decision is not valid in a non-in-person meeting, and at a second call only if that same majority is reached.
  • The administrator must elevate the approved amendment to a public deed and register it.

This is where the notary's office comes in, and only here: it records the amendment of the bylaws. It does not replace the adaptation license or the land use certificate. Ask the notary's office and the registry office for their written fee calculation; there is no single figure I can give you with certainty.

A house that is not under horizontal property does not automatically follow the path of assembly, deed, and registration. There, the change of use is decided by the urban planning norm and, if works or a change of use of the building are needed, by the license before a curator or municipal office. No one has to invent a notarial procedure for you.

And working from a computer at home? With no public or open storefront, it is not automatically an establishment requiring adaptation, but it is not exempt nationwide either: the local POT and, if there is horizontal property, the bylaws determine it. An honest difficulty: this requires reading local rules that are sometimes dense, and it is worth paying a consultation with an architect or lawyer.

What the police look at when opening to the public

Article 92 of Law 1801 of 2016 has two numerals that apply to you. Numeral 12 sanctions failing to comply with the regulated land use or the designated purpose of the building, with a general type 4 fine and definitive suspension of the activity. Numeral 14 covers whoever leases or facilitates the property against use rules, with the same fine and temporary suspension. Yes: the owner who rents it out is also liable.

Since Law 2450 of 2025, the type 4 fine equals 16 legal daily minimum wages in force. If you pay within five business days after the citation, it drops by 50%. If you disagree, you can object within the following three business days. Don't use old tables that mention 32 daily minimum wages.

If your premises serve people, besides the license there are other requirements, such as the firefighter technical concept, which is a separate document from land use.

Weekend of November 2, 2026

If you are thinking of using the holiday weekend to open a sale or an improvised shop in the living room or garage, be clear that a temporary opening does not change the use, suspend the POT, or waive article 92. The penalty does not depend on how many days the business lasts.

After the use comes everything else

Once the use is in order, the following only then makes sense: the commercial registration with the Chamber of Commerce is another step; it does not authorize the use. If you are going to lease, look at how the commercial premises leaseworks. And if what you want is to sell a business that already operates, the transfer of the establishment does not change the land use. According to active listings on Colombia Move (October 2026), there are 6 active listings for commercial properties and 9 for offices.

Frequently asked questions

❓ Does the land use certificate let me open the business?

No. The certificate only informs which uses the urban planning norm allows on your property and grants no rights. It does not replace the adaptation license or the amendment of the horizontal property bylaws when applicable.

❓ Are adaptation and modification the same procedure?

No. Adaptation authorizes changing the use of a building or part of it. Modification changes the architectural or structural design without increasing the built area. To go from residential to commercial, the procedure is adaptation.

❓ In a complex, is the administrator's authorization enough?

No. Changing the designation and amending the bylaws requires 70% of the coefficients of the entire building or complex, in an in-person meeting. Afterward, the administrator must elevate the amendment to a public deed and register it.

❓ Does working from home already count as a change of use?

There is no single national rule. Without public attendance, you must still check the local POT and the bylaws if there is horizontal property. Opening a premises to the public in a residential zone may fall under numeral 12 of article 92 (verify with the official source).

❓ How much does the certificate cost and how much the license?

If a curator issues the certificate separately, the fee is 1.67 UVT for the land use one and 8.34 UVT for the urban planning norm one. The license has no flat rate: the curator provides the calculation in writing (verify with the official source).

❓ What fine applies if the business operates against land use?

Numeral 12 of article 92 carries a general type 4 fine, equal to 16 legal daily minimum wages in force, and definitive suspension of the activity. Paying within five business days cuts the fine in half (verify with the official source).

❓ Does the notary's office change the use from residential to commercial?

No. The notary's office records the amendment of the bylaws when there is horizontal property. Use is defined by the urban planning norm and, if applicable, the adaptation license issued by the curator or the municipal authority (verify with the official source).
