Barter agreement in Colombia: vehicles, real estate, notary, and taxes
Accepting a barter is not a shortcut: each party alienates what they deliver. Here you see the proof of article 1850, the procedure for a car and real estate, the withholding, and the expenses.

You see an ad that says "trade accepted," you arrange to swap an apartment for a car plus a cash balance, and everything seems solved with a handshake. It isn't. A trade (permuta) is two disposals at the same time, and each party must formalize their own. This guide tells you when a deal is still considered a trade, what procedure each asset requires, and what taxes you might be looking at.
Quick answer: if the asset you give in exchange is worth more than the added money, it is a trade; if the money is worth as much or more than that asset, it is a sale. Real estate requires a public deed and registration at the Office of Public Instrument Registration (ORIP). A car requires a title transfer at the transit authority. And calling it a "trade" does not lower any taxes on its own.
When it is a trade and when money makes it a sale
Article 1955 of the Civil Code defines a trade as the contract in which the parties are obligated to give one species or certain body for another. Watch out for a very common mistake: that article does not talk about tax withholding (retención en la fuente). Withholding lives in the Tax Statute, and anyone who tells you that 1955 exempts you is mixing up two different regulations.
The test for mixed deals is in Article 1850: when the price is part money and part another thing, it is understood as a trade if the thing is worth more than the money, and a sale in the opposite case. An example in words: you trade your house for a lot and also receive a cash balance. If the lot is worth more than that balance, it is still a trade. If the balance is worth as much or more than the lot, the notary will view it as a sale, and that changes the applicable rules.
Another point: Article 1958 mandates applying the rules of a sale to a trade where they do not clash with its nature, and considers each party to a trade as the seller of what they deliver. Almost everything that follows comes from that.
Real Estate: public deed and registration at the ORIP
If one of the items being swapped, or both, is real estate or an inheritance right, the contract is only perfect before the law with a public deed (art. 1956). A paper signed in your living room is not enough. And signing the deed does not make you the owner either: the tradition (transfer) of ownership of real estate is done by registering the title at the ORIP (art. 756). Without registration, there is no transfer.
Before going to the notary, gather what they usually ask for:
- A recent Certificate of Freedom and Tradition (Certificado de libertad y tradición) for each property, to check for mortgages, liens, and attachments.
- Property tax clearance (Paz y salvo predial), which the notary requires before authorizing the transfer.
- Original ID cards and, if someone is acting by power of attorney, the valid power of attorney document.
My opinion: do not sign anything without reading the full Certificate of Freedom and Tradition, from top to bottom. It is boring, but that is where the lien that the other person "forgot" to mention will appear. Notaries in each area may ask for additional documents, so ask yours what else is needed.
A warning about the value: for real estate, for tax purposes, a disposal price lower than the cost, the cadastral appraisal, or the self-appraisal is not accepted (Art. 90 of the Tax Statute). Putting a "low" value in the deed to pay less is exactly what that rule closes.
Car: contract, transfer, and what not to hand over before
A car is a movable asset, so the trade is perfected by consent and does not need a deed. But that does not replace the title transfer: ownership before the transit authority is transferred at the organization where the vehicle is registered. Ministry of Transport Resolution 20223040045295 of 2022, in its text replaced by Resolution 20233040017145, essentially asks for:
- Both parties registered in the RUNT and the procedure request form.
- The contract or transfer document and the vehicle identification.
- Valid SOAT and technical-mechanical inspection.
- Clearance of fines in RUNT/SIMIT.

Here comes the security part. Handing over the car or the keys before the transfer is registered leaves you exposed: if the other person disappears, you are still listed as the owner. It is not a legal prohibition, it is common sense. The same goes for the cash balance: do not receive it in a check blindly. Read first how the bounced check scam in a trade balance works.
And a note on enormous lesion (lesión enorme): in the sale of real estate, that action exists, and due to the referral of Article 1958, it can be applied to the trade of real estate. In the sale of movable property, there is no enormous lesion, so do not count on undoing a car trade because you later feel you got the short end of the stick.

Taxes: each party to the trade disposes of what they deliver
Think of it this way: in a house-for-car trade, you sell the house and receive the car as payment; the other person sells the car and receives the house. Each has their own disposal and their own calculation of profit or loss, which is the difference between the price and the cost (art. 90). Trading is not a tax shortcut or "pays less tax" than selling.
Regarding withholding, separate two cases:
- Individual (natural person) disposing of a fixed asset: 1% withholding of the disposal value, which is paid before disposing, to the notary if it is real estate and to the transit office if it is a vehicle (Art. 398 of the Tax Statute). In a trade, each natural person calculates it on what they deliver.
- If the other party is a legal entity or there is a withholding agent: things change. According to a 2019 DIAN office letter, the paragraph of Article 401, which requires withholding as a prerequisite for the deed, does not apply to businesses other than sales, but a trade can indeed be subject to withholding for other income under that article.
Do not copy percentages from a sales guide and paste them into your trade. The regulation on withholding for the acquisition of real estate was under judicial discussion in 2026, with a suspension and then its revocation by the Council of State, and the figures that apply to each party depend on who the buyer is and the asset. That is why the notary or the transit office confirms which withholding corresponds to your deed, and an accountant ratifies it according to your case. Who pays for deed and registration
The costs of the deed of sale are divided between the parties unless they agree otherwise (art. 1862), and that rule applies to the trade where it does not clash with its nature. My recommendation: leave it written in the contract, because "we discussed it verbally" is the phrase that ends in a fight on the day at the notary.
For the record, the current resolution of the Superintendence of Notaries and Registry (Resolution 20260017266 of 2026, art. 2) states that in a trade-in (permuta), registration fees are calculated based on the higher value between the one set by the parties and the cadastral appraisal that exceeds it. If each party trades several properties, the highest value of each is taken. And if the properties are in different registration circles, the first ORIP to receive the document calculates the total.
I am not going to give you notary, registration, or departmental tax percentages, because they change according to regulations and territory, and it is easy for you to become outdated. For the other party to come seriously, include in the ad:
- Real photos, condition of the asset, and the area where it is delivered.
- What you accept in exchange (another car, a property, a lot) and if you allow a cash balance.
- That the business is formalized with a transfer or deed, and that the vehicle does not leave your hands before it is registered.
