Frequently asked questions

What does a domestic worker’s final settlement include?

The same as any employee: cesantías for the current year plus 12% annual interest, the proportional prima for the semester (a right since Ley 1788 of 2016), untaken vacation (15 business days per year), and the CST art. 64 indemnification if she was dismissed without just cause.

How do I calculate the settlement for someone who works by days?

Use the average monthly pay she actually received (day rate × days worked per month). The transport allowance is prorated by days worked: COP 249,095 ÷ 30 × days. Cesantías, interest, prima and vacation are then calculated on that base, exactly as for a full-time worker.

What is the minimum pay for a domestic worker in 2026?

Full time: the minimum wage, COP 1,750,905 per month plus COP 249,095 transport allowance. By days: at least the daily minimum wage of COP 58,364 per day worked, plus the prorated allowance.

Does room and board count as salary for a live-in worker?

Only if the contract says so. Payment in kind (food, housing) can be part of the salary, but for a minimum-wage worker it can be at most 30% of the salary (CST art. 129). Whatever is agreed as salary in kind also counts toward the settlement base.

When must the settlement be paid?

On the last day of work. Delays can trigger the moratorium penalty of CST art. 65, which starts at one day of salary for each day of delay. Pay by traceable transfer and have her sign a receipt listing each item.

Do I also owe social security and uniforms?

Yes. Health, pension, ARL and the compensation fund must be paid monthly through PILA, not at the end. Workers by days can contribute by weeks (Decreto 2616 of 2013). Anyone earning up to 2 SMMLV gets work clothes three times a year; unpaid dotación cannot be swapped for cash during the job.
