How to Get Off the Comptroller's Boletín de Responsables Fiscales (SIBOR): Full Payment, Payment Agreement, and Certificate

A payment agreement suspends coercive collection, but the rule names full payment as the grounds for exclusion. We explain the official process, the deadlines, and the disqualification.

Short answer: signing a payment agreement does not remove you from the Boletín de Responsables Fiscales. What Regulatory Resolution 074 of 2026 names as a ground for exclusion due to payment is the full payment of the obligations, supported by a act of the competent comptroller's office.

This is the most common mistake I see among people who receive a fiscal liability ruling: believing that once the agreement is signed the name disappears and they can contract again. It doesn't work that way, which is why it's worth understanding the full map before paying or signing anything.

The bulletin (SIBOR) lists natural or legal persons with a final and enforceable fiscal liability ruling whose amount remains unpaid (Law 610 of 2000, art. 60). It is a different register from the Police and Procuraduría criminal record checks; if you are looking for those, see our guide to certificados de antecedentes para empleo. It is also not the REDAM, which is another register and will not help you get out of this one. And it has nothing to do with the paz y salvo del predial.

Online certificate versus the PDF bulletin

The document that agencies review is the Certificado de Antecedentes de Responsabilidad Fiscal. It is generated at www.contraloria.gov.co, costs nothing, and since 29 March 2012 reflects the SIBOR record in real time, with the issue date and time printed on it.

The consolidated PDF bulletin is something else: a quarterly publication that the Comptroller's Office must upload within the first five business days of the month following the close of each calendar quarter (Resolution 074 of 2026, art. 2). Once the exclusion is recorded, the online certificate will already come back clean; you do not have to wait for the next PDF.

The office that manages the register is the Contraloría Delegada para Responsabilidad Fiscal, Intervención Judicial y Cobro Coactivo, through the Equipo de Trabajo del Boletín de Responsables Fiscales. If you see old pages referring to the "Delegada de Investigaciones, Juicios Fiscales y Jurisdicción Coactiva," they are out of date.

When a name appears

Only when the ruling is final and enforceable and the obligation has not been satisfied. An open proceeding or a ruling that is not yet enforceable is not what article 60 lists. The comptroller's office handling the case (the General, a territorial office, or the Auditoría General) reports the inclusion on Formulario 1 within five business days after enforceability, and the Delegada either records it or returns it within another five business days.

A practical point: you do not file these forms yourself. They are completed by the competent official; this is not a citizen self-service procedure.

Payment agreement: what it suspends and what it does not

Constitutional Court Ruling C-113 of 2022 declared article 121 of Decree Law 403 of 2020 unconstitutional, which had said that signing the agreement suspended the entry in the bulletin and the disqualification. As a result, articles 90 to 98 of Law 42 of 1993 were revived.

Today, article 96 allows a payment agreement to be signed at any stage of the coactive jurisdiction process, and its effect is to suspend the coactive proceeding and the precautionary measures already ordered. The article does not say that it suspends the SIBOR entry or the disqualification. The former 2020 regulation that ordered requesting that suspension is no longer the governing rule; do not apply it.

My advice: the agreement serves to halt seizures while you pay, not to allow you to contract. Ask the enforcing official of the comptroller's office handling your file whether the agreement is available in your case. There are no verified public figures for installments, interest, or guarantees, so be wary of anyone who promises terms without reviewing your file.

Full payment and exclusion report

This is the payment route, step by step:

  1. Pay the full amount of the obligations and keep the proof.
  2. Ask the comptroller's office that issued the ruling (or the enforcing official) to declare, in an administrative act, that it received the payment.
  3. That office completes Formulario 2 and sends it to the Delegada with the act, within five business days after the decision becomes final.
  4. If the file arrives complete, the Delegada records the exclusion within fifteen business days of receiving it.
  5. Download a new certificate and check the printed date and time.

The procedure at the Comptroller's Office is free and requires no intermediaries, according to its catalogue of procedures. Part of your job is to follow up on the act and the sending of the form, because removal depends on the reporting comptroller's office completing its part.

Other grounds, without inventing deadlines

Resolution 074 of 2026 provides only these grounds for exclusion: full payment; enforceable judicial order; loss of enforceability of the ruling; expiration of the collection action (the Comptroller General applies it according to its institutional legal position, and the sources reviewed contain no count of years); and direct revocation of the ruling.

Suing over the ruling, signing an agreement, or making a partial payment is not, by itself, a ground for exclusion. A court decision only changes the register when the competent official forwards the enforceable order. For nullity, expiration, or amount, review your file with the issuing comptroller's office or with a lawyer.

Disqualification from holding office and contracting

Under Law 1952 of 2019, art. 42, parágrafo 1 (as cited by the Función Pública in its Concepto 268581 of 2022), a person declared fiscally liable is disqualified from public office and from contracting with the State for five years from enforceability. It ends when the competent Comptroller's Office declares that it received the payment or, if payment does not apply, when the Comptroller General excludes the person from the bulletin.

If five years pass without payment or exclusion, an additional term applies depending on the amount at the time of the ruling: more than 100 SMMLV, five more years; more than 50 up to 100, two years; more than 10 up to 50, one year; 10 or fewer, three months. Your specific case may vary, so confirm it.

Separately, article 60 prohibits the appointing authority from appointing, swearing in, or contracting anyone who appears in the bulletin, and entities must check the certificate. A clean certificate also does not replace the pólizas y garantías de la contratación pública nor does it guarantee a contract.

Where to request the standard certificate and the embassy certificate

The standard certificate can be downloaded for free online. If you prefer to go in person, the Centro de Servicio al Ciudadano of the Contraloría General is at Carrera 69 No. 44-35, floor 1, Bogotá, Monday to Friday from 8:00 a.m. to 5:00 p.m. (PBX 601 518 7000).

The certificate for embassies and consulates is different: it is requested with a copy of the identity document at that address or by emailing boletin_responsables_fiscales@contraloria.gov.co, and it is delivered within ten business days. It is not the same paper you print from the website.

If you have already paid and still appear

Go back to the comptroller's office that reported your name, with the payment proof and the act that records the receipt, and ask whether it has already sent Formulario 2. Do not pay an agent who promises to remove you from the bulletin, and do not send your ID, the ruling, or the certificate through a private chat: the removal is reported by the competent official to the Delegada.

A clear limit: Colombia Move does not clear fiscal records or review rulings. This guide is a map of the procedure, not an opinion on your case.

Frequently asked questions

❓ Does signing a payment agreement remove me from SIBOR?

No. Article 96 of Law 42 of 1993 suspends the coactive proceeding and the precautionary measures, but not the entry in the bulletin. The payment ground in Resolution 074 of 2026 is full payment, and the 2020 rule that suspended the entry no longer applies (verify with the official source).

❓ How much does the fiscal records certificate cost, and is it updated instantly?

The standard certificate is free and is generated on the Comptroller's website. It reflects the SIBOR record in real time, with the date and time printed. The quarterly PDF bulletin is a separate publication, so do not wait for the next PDF to see a clean certificate (verify with the official source).

❓ Do I file the paz y salvo with the Contraloría General?

Not directly. The competent official of the comptroller's office that issued the ruling, or the coactive enforcing officer, completes Formulario 2 and sends it to the Delegada with the act declaring the payment. Your task is to obtain that act and ask that office to report it (verify with the official source).

❓ How long does the disqualification from contracting with the State last?

Five years from the ruling's enforceability. It ends earlier if the competent Comptroller's Office declares that it received the payment or, if payment does not apply, when the Comptroller General excludes you from the bulletin. If none of that happens, additional terms apply depending on the amount in SMMLV at the time of the ruling (verify with the official source).

❓ If I sue over the ruling, will I be removed from the bulletin?

Not because of the lawsuit itself. The record is excluded or suspended only when the competent official forwards an enforceable judicial order. For nullity, expiration, or amount, confirm your file with the issuing comptroller's office or with a lawyer (verify with the official source).

❓ How do I avoid a scam if I still appear after paying?

Go back to the comptroller's office that reported your name with the payment proof and ask about Formulario 2. Be wary of anyone who charges to erase the record or asks for your ID through a private chat: the removal is reported by the competent official (verify with the official source).

❓ Where do I post a job opening or my profile if I no longer appear on the certificate?

In the Empleos section of Colombia Move, stating position, city, requirements, and a direct contact. Do not upload the certificate or ID with the listing; the hiring entity checks the Comptroller's certificate on its own.
