How to Desenglobar a Plot or Rural Property in Colombia: Subdivision Permit, Family Agricultural Unit (UAF) and New Title Registration with the SNR

Selling a percentage of the farm does not give the buyer their own title. This guide explains the UAF, the exceptions under Article 45, the rural subdivision permit and the registration of the new folio.

Short answer: to sell a parcel with its own land title, a plan or a promise is not enough. You need the rural subdivision license, the division deed that formalizes it, and registration at the Oficina de Registro de Instrumentos Públicos (ORIP), which opens the new folio. If the land falls below the Unidad Agrícola Familiar (UAF), the procedure only proceeds if it fits a legal exception.

I see this a lot: an heir or landowner "sells 20%" to a buyer, with a signed paper and a sketch of the lot. Months later the buyer discovers there is no land title in their name for that parcel. Let's look at how to do it right.

What desenglobar means and what it does not

Desenglobar, in this procedure, means physically segregating a property so that each part has its own folio de matrícula inmobiliaria. Ownership transfer is perfected with the registered deed, according to Ley 1579 de 2012. A cadastral certificate, a plan, or a private purchase promise does not transfer ownership.

Selling a percentage, a share, or an undivided interest does not by itself open an independent folio. That does not mean selling a share is always illegal: it is something different from selling a lot with its own folio. But whoever buys a parcel must demand the folio of the segregated property, not just that of the parent property.

The UAF is not a national number

The Unidad Agrícola Familiar is, according to article 38 of the Ley 160 de 1994, the basic unit of agricultural, livestock, aquaculture or forestry production whose size, according to the conditions of the area and appropriate technology, allows the family to earn a living from its work and have a capitalizable surplus.

For this reason, there is no single valid hectare figure for the whole country. The UPRA calculates it by homogeneous physical units at municipal scale and provides a range. I am not going to give you a number here, because it would be making one up: confirm the range that corresponds to your property with the planning office and the land authority.

The general rule (art. 44) is that, except for the exceptions in the following article, rural properties cannot be divided below the UAF. The act or contract that produces that division is absolutely null. That is: a parcel sold below the UAF without an exception can be lost by the buyer, and you are left exposed.

The four exceptions in article 45

Be careful here, because incorrect lists circulate online. The Constitutional Court (judgment C-006 of 2002) treats art. 45 as a closed list. The exceptions are:

  • a) Donations that the owner of a larger property makes for peasant dwellings and small attached farms.
  • b) Acts or contracts that constitute smaller properties for a main purpose other than agricultural exploitation. The land must genuinely receive that purpose.
  • c) Properties that, due to special conditions, may be considered a UAF despite their reduced size. The clarification must correspond to the general subdivision project.
  • d) Judgments of acquisitive prescription for possession begun before 29 December 1961, and rights arising before that date.

The deed must record the exception. And an important clarification: "country housing" or "public utilities" are not autonomous grounds under art. 45. If your case fits literal b, you will have to prove the purpose, and the POT must allow it. I cannot promise the authority will approve it: it verifies whether the file fits.

There is also a case described by Minvivienda: a property that already had a smaller size through a public deed registered before 13 June 2003, the date of Ley 810 de 2003.

The rural subdivision license

The license is the prior authorization to physically divide properties in rural land, in accordance with the POT, agrarian, cultural and environmental norms, and guaranteeing access to each resulting property (Decreto 1783 de 2021). It is issued by the urban curator or, where there is no curator, by the municipal or district licensing authority. It is requested before the division deed.

Three practical points:

  • A rural subdivision cannot be authorized against Ley 160.
  • If you request to remain under the UAF, you must state and justify the exception in writing when filing. The authority verifies it and, if appropriate, authorizes it within the license.
  • The resulting lots only admit uses allowed by the POT and remain rural: they cannot host urban activities or form new population centers.

According to Minvivienda, the resulting properties cannot fall below the UAF or below the POT minimum, except under art. 45 or the case prior to 2003. Honestly, the most frustrating part of the procedure is that each curaduría has its own form and local attachments; confirm the one for yours or for planning.

Documents that are national

The Resolución 462 de 2017, modified by Resolución 1025 de 2021, sets the basics:

  1. Certificate of title and freedom issued no more than one month earlier. If the property has not yet been desenglobado, the one for the larger property is valid.
  2. Topographic subdivision plan, before and after, with boundary markers, delimited boundaries and an area table, signed by a licensed topographic engineer or a professional surveyor licensed under Ley 70 de 1979.
  3. If you invoke art. 45, a written statement with the justification of the ground.

Anything else is "what that curaduría or planning office requests". Do not waste money on a plan made by someone without professional registration: the curaduría will not accept it. For costs, request the liquidation in writing from the curaduría; there is no single national figure I can give you.

When the ANT comes in and when it does not

Separate three paths:

  • Private property in ordinary sale: license, deed and registration. The Agencia Nacional de Tierras (ANT) does not intervene.
  • Property awarded by INCORA, INCODER or the ANT: if it falls below the UAF, it also requires prior authorization from the ANT under art. 45. That authorization does not replace the license, because the ANT does not issue subdivision, parceling or construction licenses. According to the ANT, the permit for sale or subdivision of a property awarded by INCODER is resolved in three months.
  • Baldío: a different regime (arts. 57 and 58 of Ley 1579). Do not mix it with the desenglobe of a private estate that already has a registered owner.

Watch out for false authorizations: verify the filing number in the official ANT query. If it does not appear, the ANT itself warns that the document may be false.

Heirs and article 46

If in an estate the award of shares would produce holdings smaller than a UAF, the judge, with a hearing of the interested parties and of the Public Ministry agent, decides whether to apply ordinal 1 of art. 1394 of the Civil Code or to keep the rustic property in undivided ownership. That undivided ownership only applies to protect heirs, legatees or surviving spouses who lived on the estate and derived their livelihood from it.

Note: not every inherited undivided share is frozen. The prohibition on transferring without the judge's permission applies when the judge ordered the undivided ownership and the ruling was registered. In inheritance cases, consult a lawyer.

Deed and registration: where the new folio is born

Without a license, notaries and registrars must not authorize or register division or parceling deeds, except to comply with a court judgment (Ley 810 de 2003). Therefore the division deed formalizes the license and is registered at the ORIP of the circle where the property is located.

When registering, new folios are opened, their origin is noted, and the encumbrances, limitations and effective burdens of the larger folio are transferred. Each folio corresponds to a cadastral unit, and the registrar notifies the cadastre. The SNR publishes reference times (for example, 10 days for registration), but these are references, not a fatal deadline. The notary office and the ORIP calculate fees in writing according to the current tariff; the certificate of title has a cost, and the query of the owners index is listed as free on the SNR.

Buyers are advised to read the certificate of the new folio before giving a deposit: learn how to do it in our guide to verifying the land registration number and, if it is a country lot, in how to verify the title history of the lot.

Publishing the already segregated parcel

With the new folio in hand, you already have something concrete to show: its own registration, area, access, rural use and photos of the real property. That filters out the merely curious and avoids a deposit without a certificate. For photos, price and filters, see how to publish a lot for sale. Parcels are advertised in the housingsection. According to active listings on Colombia Move (October 2026), there are 31 active farm listings and 37 lot listings.

In short: without a license and without a new folio, there is no independent parcel to show.

Frequently asked questions

❓ Can I split a farm below the UAF?

No, unless the license authorizes an exception under art. 45 of Ley 160 de 1994 or applies the case of a deed registered before 13 June 2003 described by Minvivienda. Art. 44 sanctions the act that violates it with absolute nullity (verify in the official source).

❓ Do country housing or public utilities let me make smaller lots?

Art. 45 does not list those two figures. Its exceptions are literals a to d: donations for peasant housing, a purpose other than agricultural exploitation, properties that may be considered UAF, and prescriptions prior to 1961. In addition, the use must fit within the POT (verify in the official source).

❓ Does selling a percentage leave the lot with its own registration?

No. A share or undivided interest remains within the parent folio. Its own registration arises when the division deed, with a formalized license, is registered at the ORIP and new folios are opened under art. 51 of Ley 1579 (verify in the official source).

❓ Does the ANT replace the curaduría?

No. The license is issued by the urban planning authority; the ANT only authorizes subdivision of agrarian reform origin properties when going below the UAF, and that authorization does not replace the subdivision license (verify in the official source).

❓ What do I bring to request a rural subdivision?

A title certificate of no more than one month and a topographic plan before and after, signed by the professional required by Resolución 1025 de 2021. If you request to go below the UAF, add the written justification under art. 45; the curaduría may request local attachments (verify in the official source).

❓ How do I know the ANT authorization is not false?

Look up the filing number in the official ANT subdivision query. If the number does not appear, the ANT itself indicates the document may be false, so do not pay or sign anything on that basis (verify in the official source).

❓ How much do the deed and registration cost?

Notary offices and the ORIP charge according to the current tariff and settle the act in writing, so request the liquidation before signing. The certificate of title has a cost; the owners index is listed as free at the SNR (verify in the official source).
